Opal Cloud Estates Ltd (OCE Ltd)– Terms and Conditions

1. Contract
Opal Cloud Estates Ltd is the operating company for The Manor, Court House Farm, Clevedon properties (Pink Sunset House) and all short stays and retreats that use these properties. A binding contract is formed between OCE ltd and the Client once a booking confirmation is issued and the required deposit is received. All bookings are subject to these Terms and Conditions.

2. Provisional Bookings
Provisional bookings may be accepted subject to availability. OCE ltd will email a summary of the booking/event, which will be valid for 48 hours. No contract is formed at this stage, and either party may release the booking.

3. Booking Confirmation
A booking is confirmed upon receipt of both a signed copy of these Terms and Conditions and the non-refundable deposit. Failure to meet this condition may result in the release of the booking

4. Deposit
The non-refundable deposit is usually required to secure the booking. This prepayment is part of the total booking fee.

5. Cancellation by the Client
If you cancel or postpone, charges will apply based on notice given:
3 - 6 months prior: 50%
6 weeks+: 75%
Under 6 weeks: 100%
All cancellations must be submitted in writing. Refunds remain at the management’s discretion.

6. Cancellation by OCE Ltd
OCE ltd reserves the right to cancel without liability if:
The venue becomes unavailable (e.g., unforeseen circumstances or property sale)
Insolvency or bankruptcy of either party
The event may damage OCE ltd reputation
All monies paid will be refunded in the event of OCE ltd cancellation.

7. Final Payment
The final balance is usually due no later than three months prior to the event/stay. Late payment may result in cancellation. Payment can be made by bank transfer or PayPal (by request).

8. Compliance with Licence Conditions (Especially Weddings and Retreats)
As set by North Somerset Council:
No amplified outdoor music
Fireworks
only with prior permission, not after 10pm
External lighting by agreement only
Large events must end by: 22:30 (Mon–Sat)/ 21:00 (Sun/Bank Holidays)
Weddings: Music after 22:30 must be background-level and indoors only.
Hens/ family groups & Retreats: No outside noise in the garden after 21:00 please

9. Arrival, Departure & Waste
Check-in from 4pm; check-out by 10am. Please:
Leave the property tidy and as it was found, with furniture back in its place.
Sort waste/ recycling into: plastic, paper/card, metal/glass, and food waste please
Only one black bag of general waste/ non- recycling allowed
Any extra rubbish (e.g. from parties/hen weekends/ honeymoon etc) must be taken to Valley Road Recycling Centre (BS20 8PW) thank you
A fee will be deducted from the deposit if waste is not sorted or excessive.

10. Guest Numbers
Do not exceed the maximum number of guests agreed upon without written approval.

11. External Contractors
Only allowed with written permission. Contractors must provide risk assessments, insurance, and waste licences.

12. Loss or Damage
OCE Ltd  is not liable for any loss or damage to guests’ property.

13. Consequential Loss
OCE Ltd accepts no liability for losses resulting from event cancellation or disruption.

14. Damage
The client is responsible for any damage to the property, furnishings, or surroundings. Repair/cleaning costs will be deducted from the damage deposit.

15. Advertising
Use of the property for advertising must be approved in advance.

16. Damage Deposit ( for stays or venue hire)
Usually a refundable deposit of £1000–£2000 is payable 7 days before the event. Deductions may be made for damage to decor, furnishings etc, extra cleaning, or unpaid services. Refunds are processed within 5 working days post-departure.

17. Care of Property
The Client must leave the property in good condition.

18. Smoking
No smoking indoors. A £1000 charge applies if this is breached- taken from damage deposit. Smoking is only allowed in the designated outside area. Please dispose of cigarette ends responsibly.

19. Drains
Do not flush anything other than toilet paper. Blocked drains due to wipes or sanitary items will incur a charge.

20. Pets
(Permission required) Pets are allowed in kitchens and downstairs areas only and not on the furniture please. A fee per dog is chargeable - to be discussed with the owner..

21. Weddings – Confetti
Only natural flower petals are allowed. No rice, paper, or synthetic confetti.

22. Right of Entry
OCE Ltd staff may access the property for inspection or maintenance with reasonable notice.

23. Insurance
While not compulsory, we strongly recommend event or holiday cancellation insurance.

24. Termination
OCE Ltd may terminate bookings and require immediate vacation of the property for serious breaches, including:
Breach of licence terms (see s 8)
Serious damage
Illegal activity
Abusive behaviour
Excessive noise or complaints from neighbours or the authorities

25. Equipment Breakdown
In the event of a breakdown (e.g. hot water, internet), we aim to resolve it promptly. 

26. Accessibility
While not officially adapted for disabled access, we are happy to accommodate less mobile guests as much as possible but we must make it clear The Manor and Court House Farm is a grade 11* listed property ( see end paragraph)  so there are uneven surfaces and lots of characterful aspects to be mindful of.

27. Hot Water
Water may be hotter than expected (due to safety standards). Test before use, especially with children.

28. Health and Safety Hazards
Hot tub hazard:
Hot tub rules are displayed next to the hot tub, please familiarise yourself with them and adhere to them at all times
Slippery surfaces: Tiles, wood, and other surfaces — use caution
Fire safety: Follow posted advice- see our welcome pack. Also familiarise yourself with fire exits.
Woodburners/ fire: Use responsibly. Never leave unattended and always close down at night.

29. Governing Law & JurisdictionThis agreement is governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.

30. Force Majeure
OCE Ltd shall not be liable for any failure or delay in performance of its obligations under this agreement due to circumstances beyond its reasonable control, including but not limited to acts of God, fire, flood, war, pandemics, government intervention, or power failure.

31. Data Protection
The Client agrees that OCE Ltd may collect and use personal information for booking administration and communication in accordance with applicable UK data protection laws. Data will not be shared with third parties without consent, except where required by law.

Disclaimer & Liability
OCE Ltd accepts no legal liability for injury, death, or damage. 

Deposits and fees are non-refundable in events of war or acts of God, but we will always try to reschedule. The Client indemnifies OCE Ltd and its staff against any claims arising from these terms.

Final note from Owner:

Just to sum up, Court House Farm is a Grade 2 star listed site, ( which means its officially a national treasure) with buildings dated from the 1300s,  which although has been restored is generally not suitable for persons with very limited mobility or sight. 

It is a very old, mainly stone building, with restoration carried out to the requirements of English Heritage, in order to preserve the integrity of the ancient buildings. As a result, floors and steps are of stone and timber, and at times are slightly uneven. Aids such as handrails are safe and sufficient but limited to the history of the building. The wonderful historic feel of the building may make some parts of it atmospherically slightly darker due to the old architecture and although lit to building regulations standards it is important that anyone using the building is always careful to use the well placed light switches to put lighting on, keep hands free from carrying too much when using steps or stairs so a handrail can be used, and not presume there are any very modern intersections. 

In conclusion, we welcome guests with open arms, (even those who are less able) and want to reassure you that it is entirely safe, and has been signed off by modern building regulations but that guests will need to make allowances for the ancient nature of the property and take a little more familiarising to look out for and take care over uneven surfaces, steps, stairs etc, and especially when consuming alcohol. 

Definitions

  • “OCE Ltd” means Opal Cloud Estates, the operating company of The Manor (and other names associated with) Court House Farm and gardens, Court Lodge, Pink Sunset House ( Clevedon properties) retreats, hire and stays in these properties.

  • “Client” means the person or persons booking the property.

  • “Property” refers to the let property (The Manor, Pink sunset House…).

  • “Booking” refers to the agreement for short-term use of the Property.

  • “Event” includes weddings, retreats, and group stays.

  • “Terms” refers to these Terms and Conditions.


Binding Agreement
By making a booking, paying a deposit, ticking the website box, or signing this document, the Client agrees to be bound by these Terms and Conditions in full.
